If you are employed by an international newspaper, news agency, or broadcast media company and are being assigned to the UK for a long-term role, you may be eligible to apply for a Representative of an Overseas Business visa. This visa category is distinct from those seeking to establish a new branch of their business in the UK — in such cases, the UK Expansion Worker visa under the Global Business Mobility route would be more appropriate. Applicants must meet all the prescribed eligibility conditions to qualify.
Application Timeline and Decision Period
Those applying from outside the UK can do so up to 3 months prior to their intended date of travel. Typically, a decision is made within 3 weeks for overseas applications. For those applying within the UK, the decision-making process can take up to 8 weeks. However, you may be contacted if there are any issues, such as document verification or interview requirements. Faster processing may be available at an additional cost. You are allowed to remain in the UK while awaiting a decision, provided your application is made before your current visa expires.
Visa Duration, Fees, and Benefits
The visa allows an initial stay of 3 years and can be extended for an additional 2 years. After completing 5 years of continuous stay in the UK, applicants may qualify for settlement (Indefinite Leave to Remain). The application fee is £769 if applying from outside the UK, and £885 if applying within the UK. Additionally, you are required to pay the Immigration Health Surcharge. This visa permits full-time work with your overseas employer and the possibility to bring your spouse or children as dependants. However, working independently or accessing public funds is not allowed.
Eligibility and English Language Requirement
To qualify, you must be financially capable of supporting yourself without relying on public funds and must also meet the English language requirement. This can be fulfilled by passing a recognised English language test at CEFR Level A1 or holding an academic qualification taught in English and recognised by Ecctis. Nationals from English-speaking countries such as the USA, Australia, and Canada, among others, are exempt. Documents Required and Application Process
Applicants must submit a valid passport, financial evidence like recent bank statements or payslips, proof of English language skills, and documents showing the nature of the parent company’s business activities. A letter from your employer confirming your assignment to the UK in a long-term, full-time role is essential. Additional documents may include accommodation details and tuberculosis test results, if applicable. All non-English documents must be submitted along with certified translations. Biometric data collection is mandatory at a visa application centre or through the UKVCAS system, depending on your location.
Family Members and Extending the Visa
Your spouse, partner, or children under 18 may accompany you as dependants. Children over 18 may also qualify if they are already in the UK as your dependant. Your dependants can work and study in the UK but cannot access public funds. When you extend your visa, your family must also apply for extensions separately to ensure continuity of their stay. A successful extension requires continued employment with the same overseas organisation, and that the UK branch remains linked to the overseas company. After 5 years, the entire family may be eligible for settlement, subject to satisfying all conditions.
The Home Office will carefully scrutinise an application for any long term or temporary work visa. If it does not consider that the visa application is a genuine or if it considers that any of the other requirements have not been met, the application will fall for refusal.
